End-User License Agreement (EULA) for Insight Sphere

This End-User License Agreement (“Agreement”) is a legal and binding contract between you (“End User,” “you,” or “your”) and Andrii Butniak (“Developer,” “Company,” “we,” “us,” or “our”). This Agreement governs your access to and use of the Insight Sphere mobile application, including any updates, upgrades, and related services (collectively, the “Application”).

BY DOWNLOADING, INSTALLING, OR USING THE APPLICATION, YOU:
(A) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT;
(B) REPRESENT THAT YOU ARE OF LEGAL AGE TO ENTER INTO A BINDING AGREEMENT (OR HAVE OBTAINED PARENTAL CONSENT IF YOU ARE A MINOR); AND
(C) ACCEPT THIS AGREEMENT AND AGREE TO BE LEGALLY BOUND BY ITS TERMS.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT DOWNLOAD, INSTALL, OR USE THE APPLICATION.

1. License Grant

Subject to your strict compliance with this Agreement, Company grants you a limited, non-exclusive, non-sublicensable, non-transferable, and revocable license to download, install, and use the Application on a mobile device owned or controlled by you, solely for your personal, non-commercial entertainment purposes.

2. Nature of Service & AI Disclaimer

2.1. Entertainment Only:
The Application utilizes generative artificial intelligence (Google Gemini) to provide responses, horoscopes, and dream interpretations. THE APPLICATION IS FOR ENTERTAINMENT PURPOSES ONLY.

2.2. No Professional Advice:
You acknowledge and agree that the responses provided by the AI are generated automatically and do not constitute professional advice. The Application is not a substitute for professional judgment or advice from qualified providers in any field, including but not limited to:

  • Medical: Diagnosis, treatment, or health advice.
  • Legal: Legal counsel or interpretation of laws.
  • Financial: Investment, tax, or financial planning advice.
  • Psychological: Mental health counseling or therapy.

2.3. Accuracy:
We make no representation or warranty regarding the accuracy, reliability, completeness, or timeliness of any content generated by the AI. The AI may produce “hallucinations” (factually incorrect information). You agree to use the Application at your own risk.

3. Virtual Currency (“Mana”) and Purchases

3.1. Virtual Currency:
The Application uses a virtual currency called “Mana.” Mana allows you to access certain features (e.g., asking the Oracle).

  • Mana has no real-world monetary value and cannot be exchanged for cash, goods, or services.
  • Mana is non-transferable and can only be used within the Application.
  • We reserve the right to modify, manage, control, or eliminate Mana at our sole discretion without liability to you.

3.2. Subscriptions & In-App Purchases:
If you purchase a subscription (e.g., “Weekly,” “Monthly,” “Yearly”) or one-time items (e.g., “Spheres”):

  • Billing: Payments are processed securely via Google Play. You agree to their Terms of Service.
  • Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period in your Google Play account settings.
  • Refunds: All purchases are final and non-refundable, except as required by applicable law or Google Play’s refund policy. Deleting the app does not cancel your subscription.

4. User Conduct

You agree NOT to:

  • Use the Application to generate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or racially/ethnically objectionable.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Application.
  • Use the Application to infringe upon the intellectual property or privacy rights of others.
  • Manipulate the “Mana” system or use automated scripts/bots to interact with the Application.

5. Third-Party Services & Data Privacy

5.1. Data Processing:
Your use of the Application is also governed by our Privacy Policy (available in the Application settings). By using the Application, you consent to the collection and use of your data as outlined therein.

5.2. Third-Party Providers:
The Application integrates with third-party services:

  • Google Gemini API: Processes your text inputs to generate responses.
  • Google AdMob: Displays advertisements. AdMob may collect data (e.g., Advertising ID) to serve personalized ads, subject to your consent.
  • Google Firebase: Used for authentication and analytics.

We are not responsible for the content, accuracy, or practices of these third-party services.

6. Intellectual Property Rights

The Application, including its source code, graphics, user interface, audio, and content, is the proprietary property of the Company and its licensors. All rights not expressly granted to you are reserved by the Company.

7. Disclaimer of Warranties

THE APPLICATION IS PROVIDED TO YOU “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND DEFECTS, AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE) ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APPLICATION, EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Termination

This Agreement is effective until terminated by you or Company. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Application and delete all copies from your device. We reserve the right to suspend or terminate your account (including deleting your Mana balance) for violations of this Agreement.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Belgium, excluding its conflicts of law rules.
